Police, acting at the direction from the Coroner, will request a medical practitioner to provide a Statement and their patient records (which may need to be translated if written or if there are abbreviations). A deposition is essentially the same as a statement but may be termed differently in each State.
MIPS advises its Members make a request to the Police or Coroner to be allowed enough time to prepare their Statement. MIPS will help members prepare their Statements. Depending on the circumstances of the patient’s death MIPS may appoint lawyers immediately to protect the medical practitioners’ interests in the Coronial process, and on occasion to protect the Member in the event that the Coroner refers the Member to AHPRA.
